Sir,

              

1.        I/We have read the Rules and Conditions of allotment of plots in EPIP, Sitapura, Jaipur together with the forms thereof.

2.        I/We, the undersigned, hereby offer to take on 99 years lease the above plot of land measuring approximately............. Sq. Mtrs. On the terms and conditions set out in the form of Lease Agreement and RIICO Disposal of Land Rules 1995 for EPIP and offer to enter into Lease Agreement with you in respect of the said plot according to the said from.

3.        The lease will commence from the date from which the allotment of the plot is made to me/us and the obligations and liabilities under the Lease Agreement will be deemed to have commenced from that date.

4.        I/We enclose the accompaniment to the form of application giving necessary information in respect of my/our industry.

5.        I/We hereby agree to pay the annual rent and service charges fixed by the Corporation within 60 days from the date of order of allotment and the annual rent and service charge as revised by the Corporation from time to time every year in advance, before the 30th Aprial and 31st July respectively of that Year.

6.        I/We enclose a Bank Draft/Banker's Cheque for Rs. ................. towards amount of security money and 25% amount of development charges (Security Money calculated at the rate of 1% of total development charges subject to minimum of Rs. 2500/- calculated @ Rs. .............Per Sq. M. ) in favour of Rajasthan State Industrial Development & Investment Corporation Limited, Jaipur for the performance of the terms and conditions herein.

7.        I/We understands that no interest will be payable on the amount of security money and 25% development charges referred to in para 6 of this application.

8.        Should 1/We fail to execute and complete the agreement within 60 days from the date of allotment or within such extended period as you may permit, the Corporation will be at liberty to forfeit the security money, cancel the allotment of plot without prejudice to all other rights of the Corporation.

9.        I/We undertake to export the produce of the allotted plot to the tune of 33.33% minimum of the installed capacity every year. I/We also provide an undertaking on non-judicial stamp paper of Rs. 20/- duly notorised.

10.     Should I/We fail to export minimum 33.33% as undertaken above the Corporation will be at liberty to take over the demised premises with all assets therin (land, building, machines etc.) and cancel the allotment of plot without prejudice to all other rights of the Corporation.

11.     I/We assure that no pollution/effluent in any form (soild, liquid, gas) shall be emitted from plot and if I/We donot observe this prohibition then Corporation shall be at liberty to take over the demised premises with all assets therein and cancel the allotment of plot without prejudice to all other rights of Corporation.

12.     I/We also agree to the effect that the Corporation shall be at liberty to dispose of the taken over assets by way the Corporation understands suitable and I/We shall accept the sale proceeds after reducing all type of expenditure incurred and penalties imposed by the Corporation if any, from the amount realised on disposal of assets.

13.     I/We hereby agree to pay the special maintenance charges fixed or revised by the corporation from time to time in addition to Economic Rent and Service Charges.

14.     I/We shall pay all costs, charges and expenses of the Corporation and incidental to the preparation, execution and completion to the Lease Agreement and of the lease, including costs of all correspondence with you or otherwise, stamp, registration charges and other out going and costs of supplying one additional copy to the Corporation.

15.     The Sr. DGM, EPIP, Rajasthan State Industrial Development & Investment Corporation Limited or any other officer authorised by the Corporation will be acting on its behalf for the purpose of this application and its acceptance and for all purpose connected with the preparation and execution of the Lease Agreement.

16.     Any notice, letter or communication or intimation addressed to me/us at the following address will be deemed as valid for all purposes.

17.     I am/We are willing to accept any plot which is allotted to us by the Corporation. However, if the area applied for by me/us is changed. I/We have the option to reject the offer within a month's time from the date of issue of allotment letter.

13.Should I/We fail to deposit balance 75% Development Charge, Economic Rent, Service Charges and special maintenance charges and to execute and complete the Lease Agreement within 60 days from the date of allotment or within such extended period as you may permit or to complete the construction of main production shed after getting approval of factory building plans from the Corporation and complete the same and start production within five years from the date of execution of Lease Agreement or from date of possession (whichever is earlier) or within such extended period as you may permit the Corporation will be at liberty to forfeit the Security Money, cancel the allotment of plot & deduct the amount as per rules without prejudice to all other rights of the Corporation

ANNEXURE 'D'

UNDERTAKING

 

I/We, Shri/ Smt ……………………………….S/o, W/o Shri ……………………………age …… years ………. resident of …………………………………………………………proprietor/partner/promoter director of M/s …………………….....also on behalf of other remaining partners/ directors of above said company, undertake as following :-

 

1.     I/we shall export the produce of the allotted plot to the turn of minimum 33.33% of the installed capacity from the date of commencement of commercial production.

2.     Should I/We fail to export the produce, minimum 33.33% of installed capacity, the Corporation (RIICO) will be at liberty to take-over the demised premises with all assets therein (Land, Building, Machineries etc. ) and cancel the allotment of plot without prejudice to all other rights of the Corporation.

3.     I/We, shall also undertake to the effort that the Corporation shall be liberty to dispose off the taken over assets by way the Corporation deem fit and I/We shall accept the sale proceeds after reducing all types of expenditures incurred during this course and penalties imposed by the Corporation, if any, from the amount realised from the disposal of assets.

4.     I/We, also, undertake that no pollution / effluent in any form (solid, liquid or gas) shall be emitted from the plot. If, I/We fail in observing this condition then corporation shall be at liberty to take over the demised premises with all assets therein and cancel the allotment of plot without prejudice to all other rights of the Corporation.
